CONTEST RULES AND REGULATIONS

“September 2021 Race - A Night at the Races”

ORGANISER AND DURATION OF THE CONTEST

1. The Organiser of the “September 2021 Race - A Night at the Races” („"Contest”) is the company Nakana sp. z o.o. with its official seat in Warsaw (zip code 01-830) at Aleja Zjednoczenia 36, entered into the register of entrepreneurs of the National Court Register maintained by the District Court for the city of Warsaw in Warsaw, 14th Commercial Division of the National Court Register under the KRS number 0000739150 (the “ Organizer ”).

2. The Organizer is, at the same time, the sponsor of the Prize.

3. The Contest is held between 26 August 2021 and 20 September 2021 at 07:59am GMT.

4. The terms of participation in the Contest are strictly determined in these rules and regulations (the “Rules and Regulations”), any promotional and advertising materials are only of informative nature.

TERMS OF PARTICIPATION

1. The contest is open to natural persons with full capacity to perform acts in law, legal persons, and organizational entities without legal personality but having legal capacity (“Participant”). A person who is over 13 but below 18 years old may become a Participant to the extent that he or she may acquire rights and assume obligations under the provisions of the Polish Civil Code.

An internet connection is required to participate.

2. Employees, subcontractors or any persons which remain in a legal relationship (to which legal provisions on freelance work apply) with the Organizer, as well as family members (up to the second degree) of the said persons are not eligible to participate.

3. Prizes to win:

- Three times 30 EUR (euros) or 30 USD (US dollars) or 3000 JPY (yen) in Nintendo eShop cards (the Participant chooses which currency they want).

The winners are each of the three players who are on the top three positions on the global leaderboards in the game A Night at the Races on Nintendo Switch on Monday 20 September 2021 at 07:59am GMT

The giveaway is worldwide, so winners might receive the closest equivalent in the currency of the region they redeem the code into.

The result of the Contest (the winning Entries) shall be announced and published not later than 21 September on https://nakana.io/race.

4. In order to prove their identity as one of the three winners, participants need to send, not later than 21 September 07:59am GMT, a message to contact(at)nakana.io or @NakanaGames via Twitter or Mika [Nakana.io]#4454 via Discord. The content of the message should be a video recording of a Nintendo device showing the global leaderboards in the game A Night at the Races. If inside the video it is clearly visible that the username in yellow (meaning it's the username of the person recording and owning the Switch device) has the exact same name and score as one of the three users who were on the top 3 positions of the global leaderboards on Monday 20 September 2021 at 07:59am GMT, then the Organizer will be able to confirm this participation as one of the three winners and provide electronically one of the three Prizes to win.

5. The Organizer reserves the right to publicly announce the results of the Contest.

THE RULES OF THE COMPLAINT PROCEDURE

1. Any complaints made by the Participants as to the course of the Contest may be filed by the Participants within 14 days of announcing the final results of the Contest.

2. A complaint should be sent in writing to the official seat of the Organizer or via electronic mail to the e-mail address: contact@nakana.io.

3. The complaint should include: name, surname/business name of the participant, address for correspondence and a detailed description of the circumstances constituting the basis for the complaint.

4. Complaints files upon the lapse of the deadline determined in point 1 hereinabove shall not be processed.

5. Complaints files shall be processed within 14 days of their receipt. The interested parties shall be informed about the result of processing the complaint by registered letter sent immediately to the address provided or by e-mail.

FINAL PROVISIONS

1. These Rules and Regulations shall be made available to the Participants on this current page http://nakana.io/race-rules

2. To all matters not resolved herein, the provisions of Polish law shall apply.
